O.21 R.64: In Execution proceeding,
Application for Sale of attached movable or immovable property
The accrual of cause of action: The
Judgment Creditor, may move the executing Court under this Rule, praying that
any portion of property necessary to satisfy the decree, and which is attached
by it, and which may lawfully be sold in execution, may Ordered to be sold, and
the proceeds of such sale, or a sufficient portion thereof, be paid to the
Judgment Creditor.
The
Application may be taken in the form of a Notice of Motion / Notice / Exhibit /
Chamber Summons, as may be prescribed under the applicable provision of law,
and duly verified by the Applicant.
O.21 Rule 64: Power to order property
attached to be sold and proceeds to be paid to person entitled
Any
Court executing a decree may order that any property attached by it and liable
to sale, or such portion thereof as may seem necessary to satisfy the decree,
shall be sold, and that the proceeds of such sale, or a sufficient portion
thereof, shall be paid to the party entitled under the decree to receive the
same.
